The Client must demonstrate he has set up work in the US in his field of extraordinary ability. Prospective employment in the US is not permitted.
Proof of extraordinary achievements in the specific industry by providing AT LEAST 3 of the following evidence:
Documentation of the receipt of nationally or internationally recognised prizes or awards for excellence in the field of achievements
Documentation of the membership in associations in the field that require outstanding achievements of their members
Published material in professional or major trade publications or major media about the Client, relating to his work in the field (must include title, date, author and translation to English)
Evidence of the Client’s participation on a panel or as a judge of the work of others in his field
Evidence of the original scientific, research, or business-related contributions of major significance in the field
Evidence of the Client’s authorship of scientific articles in the field, in professional journals, or other major media
Evidence that Client has been employed in critical or essential positions in organisations and establishments that have a distinguished reputation
Evidence that the Client has earned a high salary or will earn a high salary for his services in relation to others in the field

What is USCIS?
USCIS stands for United States Citizenship and Immigration Services.It is the U.S. government agency responsible for processing immigration and visa petitions, including the O-1 visa. USCIS as the official gatekeeper for all work-related visa petitions before you go to the U.S. Embassy or Consulate for your visa interview.
What is a Petition?
In U.S. immigration, a petition is a formal request submitted to USCIS asking for permission to bring a foreign national into the United States for a specific purpose — in this case, to work under an O-1 visa.
he petition is filed using Form I-129 by a U.S.-based petitioner (your employer, agent, or sponsor). It includes all supporting documentation proving that you have extraordinary ability in your field. USCIS must approve the petition before you can apply for the visa at a U.S. consulate or embassy abroad.
What is O-1 Supporting Evidence?
1. Advisory Opinion (Consultation Letter)
A written recommendation from a relevant peer group, labor union, or expert organisation in your field. It confirms that your achievements meet the O-1 standard.
2. Detailed Itinerary or Project List
A breakdown of your planned activities or engagements in the U.S., including dates, locations, and the nature of each project.
3. Signed Contract(s)
Between you and your U.S. sponsor, agent, or employer. This outlines your work, responsibilities, and terms of collaboration.
4. Letters of Recommendation
Written by recognised experts or organisations in your industry. These letters validate your skills, achievements, and contributions to the field.
5. Evidence of Extraordinary Ability, such as: National or international awards Major press coverage or published material about you Membership in exclusive professional associations A record of high salary or remuneration Original contributions of significance in your field Media portfolio (interviews, TV appearances, publications, etc.) Lead or critical roles in distinguished organisations
6. Passport Bio Page
A copy of your valid passport showing your identity and nationality.
7. Petitioner Support Letter
A letter from your agent or employer summarising your qualifications, achievements, and the nature of your work in the U.S.
What is Form I-129 and where is it filed?
Form I-129 is the core document used to request classification for the O-1 visa.It is filed with the USCIS service center that has jurisdiction over the petitioner’s location. It can be submitted via regular or premium processing.
Who files the petition — me or someone else?
You cannot self-petition for an O-1 visa. A U.S.-based petitioner (employer, agent, or manager) must file the petition on your behalf.
What happens after USCIS receives my petition?
You receive a receipt notice (Form I-797C)
USCIS may issue a Request for Evidence (RFE) if more details are needed
If approved, you receive Form I-797 Approval Notice, which allows you to apply for the actual visa at a U.S. Embassy/Consulate
How long does it take to get a decision?
Standard processing: 2–4 months, Premium processing: 15 calendar days. Premium processing allows for 15-day expedited processing of your petition for an additional fee (currently $2,805).
Can my petition be denied? Can I appeal it?
Yes — but with some important notes:
You cannot appeal directly to USCIS, but you can:File a Motion to Reopen or Reconsider with USCIS (if you believe there was an error or new evidence is available)
Refile the petition with stronger evidence or correctionsIn some cases, consult an attorney to escalate further (e.g., AAO appeal)
Most O-1 applicants choose to strengthen and resubmit the petition rather than appeal — this is usually faster and more effective.
